Activity waiver draft
Ocean & Beach Equipment Waiver
Review draft guest-facing language for this portal document. Signature capture and attorney-approved final forms can be added as the next phase.
Not legal advice: This is starter operational text only. Before collecting signatures or relying on these waivers, have final documents reviewed by counsel familiar with Hawaii vacation rentals, premises liability, ocean activity risk, and minor/guest waiver requirements.
Guest acknowledges that use of paddle boards, kayak, boogie boards, beach toys, and any other ocean or beach equipment involves inherent and unpredictable risks, including waves, currents, reef, rocks, marine life, wind, weather, collisions, drowning, injury, and death.
Guest agrees that ocean and beach equipment may only be used by capable swimmers and only when ocean, weather, and visibility conditions are appropriate. Minors must be actively supervised by a responsible adult at all times.
Guest is responsible for inspecting equipment before use, using life jackets or safety equipment where appropriate, obeying lifeguard/local guidance, avoiding reef damage, and stopping use immediately if conditions change.
This draft is for planning and workflow only. Final waiver language should be reviewed by a qualified Hawaii attorney before use.
